Abstract

Gold mining around the Batang Gadis watershed, Panyabungan District, Mandailing Natal Regency causes water pollution, land damage, river sedimentation, as well as the use of cyanide and mercury that endanger ecosystems and health. This situation backgrounded the issuance of Regent Regulation No. 36 of 2022, which gives oversight authority to the Environmental Service (DLH), which in this study is also examined through the perspective of siyāsah dustūriyyah, particularly Ibn Taymiyyah's thought on the government's obligation to realize public welfare and prevent harm. The study aims to analyze the implementation of DLH supervision over gold mining based on this Regent Regulation and review it from the siyāsah dustūriyyah perspective, using empirical legal research methods with qualitative approaches and Miles, Huberman, and Saldana model analysis. Research results show that the Environmental Agency (DLH) has been conducting field monitoring, giving advice, reporting to the province, and carrying out cross-agency enforcement operations, but it hasn’t been optimal due to the transfer of authority to the province following Law No. 3 of 2020 and Presidential Regulation No. 55 of 2022, the lack of follow-up from the province, low public legal awareness, and weak law enforcement, as evidenced by the drop in water quality of the Batang Gadis River from class I to IV. In terms of siyāsah dustūriyyah, DLH shows good intentions but hasn’t fully achieved welfare and justice. This issue is structural due to the division of authority between government levels without effective coordination, so it’s more accurately categorized as structural institutional negligence (taqshir al-dawlah) at the provincial level not individual negligence by the district DLH.
